مكافأة الإنقاذ البحري ما بين الإستحقاق والإعفاء -دراسة مقارنة -

Résumé: تعتبر مكافاة الإنقاذ البحري عنصرا هام في حماية الأشخاص والبضائع ،ولاننسى أيضاحماية البيئة البحرية من التلوث ،وكل هذا يتجسد في زرعها ثقافة الإنقاذ البحري في نفوس المنقذين من أجل تحصيلها من مقدمي خدمة الإنقاذ ،وأيضا نشير الى دور اتفاقية بروكسل لسنة 1910 والاتفاقية الدولية للانقاذ المبرمة سنة 1989 في توحيد النصوص القانونية المتعلقة بالانقاذ البحري. تستهدف الدراسة ابراز المقصود بمكافأة الإنقاذ البحري وتكييفها القانوني ،وكذلك تسليط الضوء على شروط استحقاقها وحالات الاعفاء منها ، لنخلص الى التأكيدعلى ضرورة استحداث التعويض الخاص والصرامة في تجسيد فكرة الخطر حتى لاتكون محل اطماع المنقذين. The maritime rescue reward is a crucial element in protecting people and cargo, as well as safeguarding the marine environment from pollution. This is reflected in instilling a culture of maritime rescue among rescuers to ensure they obtain compensation from rescue service providers. Additionally, the role of the 1910 Brussels Convention and the 1989 International Convention on Salvage is highlighted in unifying the legal texts related to maritime rescue. The study aims to clarify the concept of maritime rescue reward and its legal framework, as well as to shed light on the conditions for entitlement and cases of exemption. It concludes by emphasizing the need for introducing specific compensation and strict enforcement of the risk concept to prevent it from becoming a target for opportunistic rescuers.
