العقوبات الإدارية ودورها في تجسيد إتجاه تقليص التجريم

Résumé: الإدارة وهي بصدد القيام بأنشطتها ولما تتمتع به من امتيازات السلطة العامة ،خولها المشرع اتخاذ ما تراه مناسبا من إجراءات تضمن بها حسن سير المرفق العام وتحقيق المصلحة العامة حتى ولو كان ينطوي على توقيع عقوبة إدارية على كل من مخالف النصوص القانونية والتنظيمية المعمول بها وبهذا الصدد فإن موضوع الرقابة وضمانات في الجزاءات الإدارية العامة اخذ مكانة بارزة في موضوعات القانون الإداري الحديث فا الهدف من فرض الرقابة القاضية الإداري على هذا الجانب يكمن في التأكد فيما إذا خالفت الإدارة القواعد الشكلية والإجرائية المحددة قانونا لإصدار قرار العقوبة الإدارية يقصد بها تلك الضمانات التي تضمن مشروعية الجزاءات الإدارية وذلك من خلال احترام الإدارة لمبدأ شرعية وشخصية العقوبة إضافة إلى تناسبها مع المخالفة المقترفة وعدم رجعيتها. الكلمات مفتاحيه: العقوبات الإدارية –الرقابة الإدارية –ازالة التجريم Summary: The administration, while it is in the process of carrying out its activities and for the privileges it enjoys from the public authority, is authorized by the legislator to take whatever measures it deems appropriate to ensure the proper functioning of the public facility and the achievement of the public interest, even if it involves imposing an administrative penalty on anyone who violates the applicable legal and regulatory texts. The goal of imposing administrative judge control on this aspect lies in making sure whether the administration violated the formal and procedural rules specified by law to issue the administrative penalty decision, meaning those guarantees that guarantee The legality of administrative sanctions, through the administration’s respect for the principle of legality and personality of the penalty, in addition to its proportionality with the committed violation and its non-retroactivity.
