التكييف القانوني لمسؤولية الطبيب المدنية ( دراسة مقارنة )

Résumé: تنقسم المسؤولية المدنية لقسمين رئيسيين، مسؤولية تقصيرية وهي التي تترتب على كل إخلال بواجب قانوني مفاده عدم الإضرار بالغير، أما إذا كان ذلك الإخلال ناتج عن إلتزام عقدي كانت بذلك مسؤولية عقدية، غير أن الأمر ليس بذلك الوضوح لاسيما في مجال االمسؤولية عن الأخطاء الطبية، لأن مسألة البحث عن الوصف القانوني المناسب لها كان محل جدل قضائي وفقهي واسع. لهذا خصصنا هذه الورقة البحثية لتسليط الضوء على مسألة التكييف القانوني لمسؤولية الطبيب المدنية وفقا للتصور التقليدي لما تثيره من جدل و إختلاف بين فريقين لكل منه حججه المؤسسة لتصوره و توجهه والداحضة لغيرها، والتي تأرجحت بين طبيعة تقصيرية وعقدية، ثم نخرج بمدى صمود هذا التقسيم أمام التطورات العلمية والتكنولوجية الطبية. The civil liability is divided into two main categories: tort liability, which arises from any violation of a legal duty not to harm others, and contractual liability, when the violation results from a contractual obligation. However, clarity is lacking, especially in the field of medical malpractice liability, as the legal description has been a subject of extensive judicial and doctrinal debate. This research paper aims to shed light on the legal adaptation of the physician's civil liability according to the traditional concept, which has sparked controversy and differences between two opposing sides, each presenting its institutional justifications, oscillating between tort and contractual nature. The paper also explores the resilience of this division in the face of scientific and medical technological advancements.
