Résumé: National property is divided into public real estate national property, private national real estate property, the former is protected by the rule of not disposing of it or for seizing it or for its acquisition by statute of limitations, while the private national real estate property is located in the department of ownership and exploitation, and it is disposable, but it is not subject to statute of limitations Not for reservations. National ownership of real estate, by virtue of its nature and goals, can be disposed of by public auction as an asset and by concession as an exception, after its allocation has been canceled and its inability to perform its function of public interest and institutions has been proven. The process of selling national real estate properties by public auction has social, economic and political dimensions and objectives, because the state aims from behind it to finance its financial treasury to carry out development projects that benefit the national economy. This topic will be studied by following the descriptive and analytical approach, by drawing conclusions by collecting data and information related to the sale of national real estate properties by public auction.تنقسم الأملاك الوطنية إلى أملاك وطنية عقارية عمومية، وأملاك وطنية عقارية خاصة، فالأولى محمية بقاعدة عدم التصرف فيها ولا للحجز عليها ولا لاكتسابها بالتقادم، أما الأملاك الوطنية العقارية الخاصة، فهي تقع في دائرة التملك والاستغلال، وهي قابلة للتصرف فيها، لكنها تظل غير قابلة للتقادم ولا للحجز عليها. فالملكية الوطنية العقارية الخاصة بحكم طبيعتها وأهدافها، يمكن التصرف فيها عن طريق التَّنازل بالمزاد العلني كأصل والتَّنازل بالتراضي كاستثناء، وذلك بعد أن يتم إلغاء تخصيصها وثبوت عدم قابليتها لتأدية وظيفتها في عمل المصالح والمؤسسات العمومية. إن عملية بيع الأملاك الوطنية العقارية الخاصة بالمزاد العلني لها أبعاد ، و أهداف اجتماعية ،و اقتصادية ،و سياسية، لأن الدولة تهدف من ورائها إلى تمويل خزينتها المالية لانجاز مشاريع تنموية تعود بالنفع على الاقتصاد الوطني. و ستتم دراسة هذا الموضوع من خلال إتباع المنهج الوصفي التحليلي ، باستخلاص النتائج عن طريق جمع البيانات و المعلومات المتعلقة ببيع الأملاك الوطنية العقارية الخاصة بالمزاد العلني
