اجراءات الحد من مخالفات رخصة البناء

Résumé: ان السعي الى تنظيم النشاط العمراني والحد من البناء الفوضوي لا يقتصر على الرقابة التي تمارسها السلطة الادارية من خلال فرض تراخيص البناء فقط ،وانما تطلب الامر رقابة ميدانية تهدف الى تدارك المخالفة العمرانية قبل استفحالها وتطبيق العقوبة على مرتكبيها . لذلك ،وأمام التزايد المستمر للمخالفات والتجاوزات العمرانية التي تشهدها مدننا اليوم ، مكن المشرع الجزائري الجهات الادارية من مراقبة اشغال البناء اثناء تنفيذها ووسع من صلاحيات رئيس المجلس الشعبي البلدي والوالي ، وجعل لهم الصلاحية في تسليط الجزاء الاداري المتمثل في "الهدم" الكلي للبناء المخالف دون الرجوع الى القضاء، وذلك بموجب القانون رقم 04-05 المعدل لقانون التهيئة والتعمير. Attemptingto regulate the urban activity and put an end to the chaotic construction is not just limited to the control exercised by the administrative authority through the imposition of building permits, but requires a field control that aims at remedying the urban violation before it escalated and applyingpenalties to the malefactors. Therefore, faced with the continuous increase of infractions and urban violations witnessed by our cities nowadays, the Algerian legislator enabled the administrative authorities to monitor the construction works during theirexecution and expanded the powers attributed to the President of the People's Assembly and the Governor, and granted to them the authority to inflict administrative penalty being the total "demolition" of the perpetrator’s buildings without recourse tojustice. In accordance with the Law no. 04-05 amending the law on the territory planning andurbanism.
