أثر التصرفات الدولية الانفرادية على قواعد العرف الدولي - الاحتجاج و التحفظ نموذجاً-

Résumé: ملخص: يعد العرف أهم مصادر القانون الدولي وأكثرها إنشاء لأحكامــــــــه ويستدل في ذلك إلى أن قواعد القانون الدولي ترجع في نشأتها إلى العرف، ومن ثم تحتل القواعد العرفية مكانه هامة في النظام القانوني الدولي. إن من سِمات قواعد العرف الدولي أنها تسري في مواجهة كافة أعضاء الجماعة الدولية، أي إنها تطبق بعد نشوءها على كافة الدول، سواء من ساهمت في تكوينها أم لم تساهم، إلا أن تطور المجتمع الدولي أفرز بعض الأعمال و التصرفات التي قد تؤثر على قواعد العرف الدولي. في هذه الدراسة سيتم البحث عن أثر الاحتجاج والتحفظ على سريان قواعد العرف الدولي. Summary: Custom is the most important source of international law, and most of the rules of international law are due to their custom, Thus, customary rules occupy an important place in the international legal order. International custom rules binding to all countries, whether they contributed to its composition or not, but the development of the international community has shown some international behavior that may affect the rules of international custom. In this study, we examine the impact of protest and reservation on the validity of international customary rules.
