الاجتهاد الفقهي في ضوء مصادر التشريع

Résumé: ملخص إن قواعد أصول الفقه هي المحرك الأساسي لعملية الاجتهاد، فهي التي طورته عبر العصور وبدوره أدى إلى تطور الفقه الإسلامي ومناهج البحث فيه، وهي التي تسهم في دفع الفقه الإسلامي المعاصر وتجديده، كما فتحت آفاق الاجتهاد في هذا العصر والتقدم الفقهي والتشريعي وستظل هذه القواعد هي التي ترسم معالم الاجتهاد وتطور الفقه تبعا لذلك. وفي هذه الصفحات بيان لأهم مناهج الاجتهاد في ضوء مصادر التشريع انطلاقا من بيان اعتبار نصوص القرآن والسنة، ثم اعتبار التعليل والنظر في علة الحكم من خلال توضيح ضرورة التعليل لإيجاد الأحكام لغير المنصوص، وأهم آليات الاجتهاد فيما ليس فيه نص في الشريعة الإسلامية. ABSTRACT: The rules of jurisprudence is the main driver of the process of Ijtihad, which are developed through the ages. This has led to the development of Islamic Jurisprudence and its research methods, that contribute to the development of contemporary Islamic jurisprudence, and it opened the prospects of Ijtihad, progress doctrinal and legislative in this era. These rules will continue to develop accordingly landmarks of Ijtihad and the evolution of jurisprudence. These pages indicate the most Ijtihad approaches in light of the sources of legislation, on the basis of the texts of the Quran and Sunnah, Then reasoning and considering reason judgment by clarifying the need to find provisions for matters not provided for, and the most important modes of Ijtihad where there is no provision in Sharia.
