مسؤولية الموقع الصرفي مابين تضامنه الخارجي والداخلي في قانون الصرف

Résumé: الملخص: يعد التضامن مبدأ من مبادئ القانون التجاري، وأحد أهم الضمانات التي يعتمدها قانون الصرف من أجل حصول حامل الورقة التجارية على قيمتها عند ميعاد استحقاقها، إذ يحق لهذا الأخير الرجوع على أي موقع أو على جميع الموقعين بكامل قيمة الورقة التجارية بحُكم تضامنهم في حالة ماإذا امتنع المسحوب عليه عن الدفع أو القبول تطبيقا لقاعدة التضامن الخارجي، كما أعطى قانون الصرف للموقع الموفي حق الرجوع على باقي الموقعين بكامل قيمة هاته الورقة التجارية التي أدّاها للحامل تطبيقا لقاعدة التضامن الداخلي. Abstract: Solidarity is one of the principles of commercial law, and one of the most important guarantees adopted by the exchange law in order for the holder of the commercial paper to obtain its value at its due date, as the latter has the right to return to any site or to all signatories for the full value of the commercial paper by virtue of their solidarity in the event that the drawee refuses He shall be liable for payment or acceptance in application of the rule of external solidarity, and the exchange law gave the paying signatory the right of recourse to the rest of the signatories for the full value of this commercial paper that he paid to the holder in application of the rule of internal solidarity.
