النظام القانوني للنقل الدولي متعدد الوسائط

Résumé: ملخص: يتمتع النقل بشكل عام بأهمية استراتيجية في دول العالم أجمع منذ القدم ، باعتباره عصب التجارة ، داخلية أو دولية على حد سواء ، و أمام تطور نمط نقل البضائع عموما من أماكن الإنتاج إلى أماكن التوزيع و الاستهلاك بإستخدام أكثر من واسطة نقل ، ظهر ما يعرف بالنقل متعدد الوسائط ، يأخذ بموجبه متعهد النقل البضائع في حراسته و يسأل عنها و يتولى نقلها إلى المكان المسمى للتسليم مقابل أجر ، لذا كان لزاما أن يتم مثل هذا النوع من النقل بموجب عقد واحد يغطي عملية نقل دولي بكافة مراحلها وتحت مسؤولية محرر هذا العقد الذي يطلق عليه إسم متعهد النقل متعدد الوسائط l’opérateur de transport multimodal ". Abstract: transport in general enjoys a strategic importance in the countries of the whole since ancient times, as it is the backbone of trade internally alike, and in front of the pattern of transporting goods in general from the places of production to the places of distribution and consumption using more than one means of transport. Whereby the carriage contractor takes the goods into his custody and asks for them and takes them to the designated place for delivery in exchange for a fee, so it was imperative that this type of transportation be carried out under a single contract covering an international transport process in all its stages and the responsibility of the editor of this contract which is called the contractor multimodal transport “l’opérateur de transport multimodal “.
