المحكمة الجنائية الدولية بين فكي العدالة الجنائية والسياسة الدولية

Résumé: تعتبر المحكمة الجنائية الدولية هيئة قضائية مستقلة في نشأتها عن الأمم المتحدة لكنها مرتبطة عمليا بها على مستوى جهاز مجلس الأمن إضافة إلى أنها جهاز مكمل للولاية القضائية الوطنية. وتتمثل علاقة مجلس الأمن بالمحكمة الجنائية الدولية من خلال منحه سلطة الإحالة، والتي تسمح بإمكانية متابعة الأشخاص مهما كانت درجة منصبهم ومسؤوليتهم، وذلك حتى في الحالات التي لم تنضم فيها دولهم أو الدول التي ارتكبت جرائم فوق إقليمها إلى النظام الأساسي للمحكمة فيصبح لهذه الأخيرة إمكانية ممارسة اختصاص عالمي بفضل تدخل مجلس الأمن في نشاطها، والسماح له بذلك من خلال سلطة الإحالة الممنوحة له، غير أن هناك ما يشوب هذا الاختصاص والعلاقة بين جهازين ذا تركيبتين مختلفتين. الكلمات المفتاحية: المحكمة الجنائية الدولية، مجلس الأمن، الإحالة، نظام روما. Abstract : The International Criminal Court is an independent judicial body in its inception from the United Nations, but it is practically linked to it at the level of the Security Council service, in addition, it is a complementary part to national jurisdiction. The relationship of the Security Council with the International Criminal Court is represented by granting it the referral authority, which allows the possibility of pursuing persons regardless of the degree of their social statuses, even in cases where their countries or others that committed crimes on their territory have not joined the statute of the Court, so the latter has the possibility to exercise the jurisdiction world thanks to the intervention of the Security Council in its activity, and allowing it to do so through the referral authority. However, there is something tainting this jurisdiction and the relationship between the two bodies with two different structures, one of which is judicial and the other which is political.
