التسجيل المسبق للاستثمارات طبقا للقانون رقم 22-18 المتعلق بالاستثمار

Résumé: يعتبر الاستثمار عموما والاستثمارات الأجنبيّة المباشرة خصوصا أحد الآليات الأساسيّة لإنعاش اقتصاديات الدول ونموّها، لذلك لجأت الدولة الجزائريّة إلى تحسين مناخ الأعمال وتعزيز الثقة في المنظومة القانونيّة للاستثمار؛ لاسيّما من خلال تكريس مبدأ حرية الاستثمار والشفافية والمساواة في المعالجة؛ وكذا إحاطة الاستثمارات بضمانات قانونيّة ومنحها تحفيزات ماليّة ومرافقتها بمجموعة من الخدمات، غير أنّ تأهيل الاستثمارات للاستفادة من هذه التدابير، التي تضمنها قانون الاستثمار رقم 22/18، مرتبط بضرورة استيفاء المستثمر لشرط جوهري ألا وهو التسجيل المسبق للاستثمار. يثير هذا الإجراء تساؤلات تتعلق بطبيعته القانونية وحدود سلطة تدخل الوكالة الجزائرية لترقية الاستثمار، ومدى إمكان اعتباره وسيلة تنظيمية فعالة لتوجيه ومراقبة الاستثمارات وخطوة نحو تحسين مناخ الاستثمار. Investment in general and foreign direct investment in particular being considered as one of the main mechanisms of revival and growth of the economies of the countries, Thus, the Algerian State has resorted to improving the business climate and strengthening confidence in the investment legal system; In particular by enshrining the principle of freedom of investment, transparency and equal treatment; In addition to surrounding the investments with legal guarantees and granting them financial incentives and accompanying them with a set of services, However, the investments eligible to benefit from these measures, which are included in the Investment Law n ° 22/18, are linked to the need for the investor to fulfill an essential condition, which is the prior registration of the investment. This procedure raises questions related to its legal nature and to the limits of the power of intervention of the Algerian Agency for the promotion of investments, and to the extent to which it is considered as an effective means of regulation, in order to direct and to control investments, and a step towards improving the investment climate in Algeria.
