ترميم الآثار وموقف الفقهاء: دراسة فقهية مقارنة بالقانون الجزائري

Résumé: يتركز البحث حول موقف الفقهاء والمعاصرين من مسألة ترميم الآثار؛ استنادا على تراث الفقه الإسلامي وقواعده, وبيان مدى كفاية القوانين الجزائرية ذات الصلة في إضفاء الحماية المطلوبة على الآثار من جهة ترميمها؛ بعدم مخالفة القواعد والإجراءات والشروط المنصوص عليها في هذا الشأن, ومطابقة ذلك مع الواقع العملي. والدراسة هي مقارنة بين الفقه الإسلامي والقانون الجزائري, وقد عرضت فيها خلاف الفقهاء بشأن ترميم الآثار وأدلتهم ومناقشة هذه الأدلة. وفي ضوء ذلك ذهبت إلى ترجيح القول بتأييد الترميم، وذكرت أسباب الترجيح. وهذا الرأي يتفق مع القانون الجزائري الذي أيّد الترميم بشروط وإجراءات وضوابط, لكن الواقع العملي يشهد اعتداء مقصودا وغير مقصود على الآثار بمخالفة هذه الضوابط بقلة التمويل والوسائل من جهة, وضعف العقوبة المرصودة للمخالفة من جهة أخرى. فضلا عن الإفلات من العقاب. The study focuses on the position of scholars and contemporains on the issue of restoration of antiquities, based on the heritage of Islamic jurisprudence and its rules, and the adequacy of the relevant Algerian laws in providing the required protection on the monuments from the point of restoration; not violating the rules, procedures and conditions provided in this regard. and matching it with a practical reality. In light of this I went to support the restoration, citing the reasons of ponderation. This view is consistent with Algerian law, which supported the restoration with conditions, procedures and controls. However, the practical reality witnessed a deliberate and unintentional attack on the Antiquities by violating these controls with the lack of funding and means on the one hand, and the weakness of the penalty allocated to the violation on the other hand.
