أثر فساد بيت المال في فتاوى الفقهاء -دراسة تحليلية-
Résumé: ملخص: تغير الفتوى بتغير الزمان قاعدة نص عليها الأصوليون، ومن فروعها تغير الفتوى بسبب فساد بيت المال وعدم انتظامه، وقد هدف البحث إلى بيان أثر هذا التغير على فتاوى الفقهاء، مستخدما المنهج الاستقرائي والمنهج التحليلي، فانتهى الباحث إلى أن هذا المتغير مؤثر فعلا في الفتوى، حيث وجدنا الفقهاء يعدلون عن مذاهبهم الأصلية تحصيلا لمقصد الشارع من بيت المال، مستخدمين في ذلك قواعد أصولية وفقهية يأتي على رأسها سد الذرائع والاستحسان وقاعدة الضرورة وغيرها، وهذا ما يؤكد عدالة الفقهاء، ويحطم شبهة الطعن فيهم. Abstract : The rule of the fatwa changes with the change of time, an example of which is the change of the fatwa due to the corruption of the public treasury. Legitimacy rules and jurisprudential rules, and this confirms the integrity of the jurists, and highlights the error of their accusation.
