سلطة حل المجلس الشعبي الوطني في ضوء التعديل الدستوري لسنة 2020

Résumé: تضمن التعديل الدستوري لسنة 2020 مختلف الضوابط المرتبطة بحل المجلس الشعبي الوطني باعتباره من أخطر الآليات التي تحوزها السلطة التنفيذية في مواجهة السلطة التشريعية، لاسيّما من خلال إلزام إعادة إجراء الإنتخابات التشريعية في الأجل المحدد ومنع تفويض صلاحية الحل، مع ما تقضيه من ضرورة تعزيز الضمانات الدستورية لمنع إساءة استخدام إجراء حل المجلس الشعبي الوطني وما يترتب عليه من تعطيل للحياة البرلمانية. The constitutional amendment of 2020 included various controls related to the dissolution of People’s National Assembly, as it is one of the most dangerous mechanisms possessed by the executive authority in the face of the legislative authority, especially by obligating; the re-conducting of legislative elections within the specified time, preventing the delegation of the power of dissolution and the inability to dissolve in exceptional cases. With what it stipulates of the necessity of strengthening constitutional guarantees to prevent abuse of the procedure of dissolving the People's National Assembly and the consequent disruption of parliamentary life.
