مسؤولية المقاول من الباطن عن الضمان العشري في القانون المدني الأردني

Résumé: الملخص تعد مسؤولية المهندس والمقاول عن سلامة ما يشيداه من مبانٍ ومنشآت، من المسائل الهامة التي أولاها المشرع الأردني في القانون المدني الأردني أهمية خاصة، واعتبر المهندس والمقاول متضامنين في التعويض لصاحب العمل عما يحدث في خلال عشر سنوات من تهدم كلي او جزئي للبناء، وعن كل عيب يهدد سلامة ومتانة البناء إذا لم يتضمن العقد مع صاحب العمل مدة أطول .إلا إنه ونظرا لتطور الحياة العملية وتوسع أعمال المقاولات ؛ فقد أدى ذلك إلى دخول المقاول من الباطن إلى عملية البناء والتشييد، فهل يعتبر المقاول من الباطن خاضعا لأحكام المسؤولية العشرية( الضمان العشري)؟ هذا ما ستحاول الباحثة الإجابة عنه في هذا البحث. Abstract The responsibility of the engineer and the contractor, for the safety and solidity of the buildings and installations they construct, is one of the important issues that the Jordanian legislator has in the Jordanian Civil code, is of particular importance, and the legislator considers both of them shall be guarantors in compensating the owner of the building, if a whole or partial demolition occurs to buildings or installations within ten years. They shall also compensate the owner for any defects that threaten the solidity, durability and the safety of the building if the contract does not include a longer period. However, due to the development of working life and the expansion of contracting work, this has led the sub-contractor to enter the building and construction process. Is the sub-contractor subject to the terms of the ten-year guarantee responsibility? This is what this study aims to discuss.
