القواعد والضوابط الفقهية في باب النكاح عند المالكية جمعا ودراسة

Résumé: تهدف هذه الدراسة إلى جمع ودراسة القواعد والضوابط الفقهية في باب النكاح عند المالكية، وذلك انطلاقا من الإشكالية الآتية:ما هي القواعد والضوابط الفقهية التي استنبطها العلماء وفقهاء المالكية في تأصيل المسائل الفقهية في باب النكاح؟ فمن هذه القواعد " الأصل في الفروج التحريم"، ومن الضوابط " كل نكاح انعقد بصحة بين الزوجين فإن المرأة بذلك العقد خاصة دون المسيس تحرم على أبي الزوج وعلى أجداده وعلى ولده وولد ولده أبدا وتحرم أمها أبدا بذلك العقد"،ومن النتائج المتوصل إليها أن لكل قاعدة أو ضابط فقهي مدلول يستند إليه من الكتاب أو السنة، وأن القواعد والضوابط حجة يستدل بهما في استنباط الأحكام، وأن القاعدة والضابط ليسا الشيء نفسه."This research aims to collect the study of the rules and juresprudenceregulaticens in chapter of marriage at Almalikiadoctrine, wich starts from the following issue: what is the rules and the juresprudents of Almalikia doctrine had deduced it in stabilazing the jureprudence issue in marriage's chapter? There is a rule from thies rules wich is "" the origin in volva is the prohibition"" and the regulation are"" every marriage had correctly confirmed between the husband and the wife, so the woman (especially with that confirmation) without touching, is forbiden on the husbend's father and his grandfathers and his child and the child of the child conclusively, and also her mother forever by that agreemet, and the resaultswich had reach them, that every rule or jurepudence regulation had a signification based on, from the holy book and sunnah, and the rules and the regulaions are an argument,wich inferred them in deducing judgements, and the rules and regulations are not the same.
