مبدأ استمرارية سير المرافق العمومية كضمانة دستورية لحماية الحقوق و الحريات في الجزائر.

Résumé: تهدف هذه الدراسة إلى إبراز أهمية العلاقة بين الإدارة والمواطن, والتي تكون فيها المرافق العمومية أهم الوسائل التي تعتمد عليها الدولة في تقديم الخدمات للمواطنين في كل الظروف والأحوال بصورة منتظمة دون توقف أو انقطاع, هذا ما يضمن للمواطن حماية احد أهم حقوقه الحديثة والمتمثل في حقه في الحصول على الخدمة متى أراد ذلك, لذا نجد الدولة ملزمة بالسعي لضمان استمرارية سير المرافق العمومية بانتظام حتى في الظروف الطارئة من خلال التحول إلى المرفق العام الالكتروني واستخدام الوسائل التكنولوجية الحديثة للحفاظ على الاتصال الدائم بين الإدارة والمواطن, لذا حرص المشرع على إعطاء هذه العلاقة مكانة مرموقة من خلال الإقرار الدستوري للمبادئ التي تقوم عليها هذا ما نص التعديل الدستوري لسنة 2020 بصريح العبارة حيث جعل من مبدأ سير المرافق العمومية مبدأ دستوريا يكفل من خلاله للمواطن حماية حقوقه في الاستفادة والانتفاع من خدمات المرفق العام ضد كل انتهاك أو إخلال . This study aims at showing the importune of the relationship between the administration and the citizen where the public facility is the most important tool on which the state relies to provide services for the citizens in all the circumstances in a continuous manner to guarantee one of the modern rights of the citizen that is getting services whenever he wants. Thus, the state is committed to guarantee the continuity of the public facility regularly even in emergencies through moving to the electronic public facility and the use of modern technological tools to maintain the continuous contact between the administration and the citizen. Therefore, the Legislator made sure to give a special position for this relation through the constitutional recognition of the principles on which it bases as provided for by the constitutional amendment in 2020 in a clear way. It made the principle of the continuity of the public facility a constitutional principle that guarantees for the citizen the right of .benefitting from the services of the public facility without any violation of this right
