النظام القانوني للسلطة الوطنية المستقلة للانتخابات في الجزائر وفقا للأمر 21/01 المتضمن القانون العضوي للانتخابات

Résumé: الملخص: للعملية الانتخابية أهمية بالغة في تكريس ممارسة الشعب للسلطة، من خلالها تتجسد إرادته في الاختيار الحر والنزيه لممثليه على مستوى جميع المؤسسات المنتخبة. ولإضفاء النزاهة والشفافية على العملية الانتخابية حاولت الدول تبني ثلاث أشكال للإدارة الانتخابية هي الإدارة الحكومية والإدارة المستقلة وكذا الادارة المختلطة. وفيما يخص المؤسس الجزائري فقد تبنى هيئة مستقلة للانتخابات تحت مسمى السلطة الوطنية المستقلة للانتخابات بموجب المادة 200 وما يليها من التعديل الدستوري لسنة 2020، ثم أحال أمر تنظيمها على قانون الانتخابات الأمر رقم 21/01. على هذا الأساس تعالج هذه الدراسة الأحكام القانونية المتعلقة بالسلطة الوطنية المستقلة للانتخابات كمؤسسة مستقلة تسهر على إدارة العمليات الانتخابية. Abstract: The electoral process is crucial to the people's exercise of power, through which their will is reflected in the free and impartial choice of their representatives at the level of all elected institutions. To ensure the integrity and transparency of the electoral process, states have adopted three forms of electoral administration; namely, government administration, independent administration, and mixed administration. With regard to Algeria’s context, the Algerian founder’s constitution has adopted an independent electoral body called the Independent National Electoral Authority under Act 200 et seq. of the constitutional amendment held in 2020, which was subsequently regulated by the Organic Law on the Electoral System, authoritative order No. 21/01 of 10/03/2021. On this basis, the present study addresses the legal provisions concerning the Independent National Electoral Authority as an independent institution for the organization and management of Algeria's electoral process.
