Résumé: الملخص بالعربية : لطالما ثار التساؤل حول ما إذا كان رئيس الجمهورية مسؤول عما ارتكبه من جرائم، و قد تطورت المسؤولية الجزائية لهذا الأخير إلى أن أصبح في العديد من الدساتير مسؤول عما يرتكبه من جرائم و على رأسها الخيانة العظمى، و لو أنه وجد قصور من حيث تجريم هذا النوع من الأفعال لذا سعت الدساتير إلى تغطية هذا القصور بتجريم أفعال أخرى قريبة منه منها الإخلال الجسيم بالدستور و لو أنه إلى اليوم تبقى المسؤولية الجزائية لرئيس الدولة عن هذا الفعل و غيره منقوصة لاعتبارات عديدة. There has always been a question about whether the President of the Republic is responsible for the crimes he committed, and the criminal responsibility of the latter has evolved to the point where he became in many constitutions responsible for the crimes he commits, chiefly treason, even if he found deficiencies in terms of criminalizing this type of Actions Therefore, constitutions sought to cover this deficiency by criminalizing other acts close to it, including a serious breach of the constitution, even if to this day the criminal responsibility of the head of state for this act and others remains incomplete for many considerations.
