المجلس الوطني لحقوق الإنسان كبديل للجنة الاستشارية لحماية وترقية حقوق الإنسان

Résumé: -الملخص- أكد إعلان فيينا (1993)، ثم قرار الجمعية العامة للأمم المتحدة رقم 48/134 الصادر بتاريخ 20 ديسمبر 1993، والمتعلق بالمؤسسات الوطنية لتعزيز وحماية حقوق الإنسان، أهمية إقامة مؤسسات وطنية لتعزيز وحماية حقوق الإنسان. وعليه وضعت الأمم المتحدة مجموعة من المعايير الدولية كمؤشر لاستقلال هذه المؤسسات، وامتلاكها لقدرات أدائها وظائفها تعرف بمبادئ باريس لعام 1993. كانت اللجنة الوطنية الاستشارية لترقية و حماية حقوق الإنسان في الجزائر المؤسسة الوطنية المختصة بحقوق الإنسان. غير أن اللجنة الوطنية الاستشارية تعرضت لانتقاد كبيرة منذ نشأتها، سواء على المستوى الداخلي او على المستوى الدولي، مما أدى لإلغائها وإنشاء المجلس الوطني لحقوق الإنسان بموجب التعديل الدستوري لعام 2016 بنص المادتين 198و199، ثم صدور القانون رقم 16-13 بتاريخ 03 نوفمبر2016، الذي ينظم المجلس الوطني لحقوق الإنسان ، والذي أدى لاعتباره هيئة دستورية يلاحظ أنها تتوافق مبدئيا مع المعايير الدولية لهيئة الأمم المتحدة. -ABSTRACT- The Vienna Declaration (1993) and United Nations General Assembly resolution 48/134 of 20 December 1993 on national institutions for the promotion and protection of human rights emphasized the importance of establishing national institutions for the promotion and protection of human rights. Accordingly, the United Nations has established a set of international standards as an indicator of the independence of these institutions and their ability to carry out their functions known as the Paris Principles of 1993. The National Committee for the Promotion and Protection of Human Rights in Algeria was the national human rights institution. However, the National Consultative Committee has been subjected to considerable criticism since its inception, both domestically and internationally. This led to its abolition and the establishment of the National Council for Human Rights under the 2016 constitutional amendment in articles 198 and 199, and the promulgation of Law No. 16-13 of 03 November 2016, The National Council for Human Rights, which has been considered a constitutional body, notes that it is in principle compatible with international standards of the United Nations.
