قاعدة مراعاة العرف في الفتوى المالكية وأثرها في خصوصية النوازل الفقهية المغربية

Résumé: جاءت الشريعة الإسلامية والكثير من الأعراف البشرية متأصلة في النفوس، فسلكت معها مسلكاً حكيماً يتسم بالتدرج وعمق المعالجة، وحددت إطاراً عاماً، لم تسمح لتلك الأعراف بتجاوزه مهما بلغت درجة قوتها في النفوس؛ فأبقت على الأعراف الموافقة للتعاليم السماوية، وبنت على بعضها الكثير من الأحكام، في حين استبعدت ما خالف الشرع بحكمة وروية. وقد أوضح الونشريسي من خلال بعض النوازل والفتاوى الفقهية العديد من العادات والتقاليد والأعراف المغربية في العصر الإسلامي، والتي تتوافق مع الشرع، والأخرى المنافية له، منها عادة الجهر بالتهليل أمام الجنائز، والاحتفال بالمولد النبوي الشريف، والاحتفال بميلاد أطفالهم.
