الحماية القانونية للام الحامل من الاجهاض في التشريع الجزائري

Résumé: تناولنا في هذه الدراسة الإجهاض بين التجريم والاباحة كحماية جنائية لصحة الام الحامل في التشريع الجزائري مبينين من خلالها الضمانات القانونية التي كرسها المشرع الجزائري حماية لصحة الام الحامل و ذلك بتجريم الإجهاض لغير ضرورة و معاقبة فاعله حتى لو كانت الام نفسها بغض النظر عن حدوث نتيجته، اما اذا شكل الحمل نفسه خطرا يهدد حياة الام و صحتها تدخل المشرع و أباح الإجهاض اذا توفرت دواعيه والتي حصرها في قانون العقوبات في حالة الضرورة فقط، وفي المقابل توسع في مبرراته في قانون الصحة الجديد بحيث اعتبر كل خطرا يهدد توازن الام النفسي والعقلي مبررا كافيا لإجراء الإجهاض دون إعطاء معيار دقيق وواضح يحدد هذا الخطر، ومع ذلك قيد عملية اجراء الإجهاض العلاجي بضوابط قانونية تحت طائلة العقاب عند مخالفتها في قانون العقوبات وقانون الصحة الجديد رقم 18/11، ولضمان تطبيق هذه الضوابط اكد المشرع الجزائري على اجراءه في المؤسسات الاستشفائية العمومية. Abstract: In this study, we examined abortion between criminalization and permission as criminal protection for the health of pregnant mothers in Algerian legislation, through which the legal safeguards enshrined legislation protect the health of pregnant mothers by criminalizing abortion unnecessarily and punishing the perpetrator even if the mother herself regardless of the outcome. If the pregnancy itself constitutes a threat to the mother's life and health, the legislator intervened and permitted abortion if there were reasons for it, only in cases of necessity, In contrast, the new Health law expands its justification so that any threat to the psychological and mental balance of the mother is considered sufficient justification for performing an abortion without giving a precise and clear criterion determining the risk. In order to ensure the application of these regulations, the Algerian legislature has confirmed the procedure in public hospital institutions
