عقود الإيجار والإجارة المنتهية بالتمليك -دراسة مقارنة بين معايير الإيجار التقليدية والإسلامية-

Résumé: تهدف هذه الدراسة إلى مقارنة عقد الإيجار وفق المعيار الدولي لإعداد التقارير المالية IFRS16 معيار الإجارة والإجارة المنتهية بالتمليك الصادر عن هيئة المحاسبة والمراجعة للمؤسسات المالية الإسلامية AAOIFI ، بحيث تم التعرف على أداة التمويل مع عقد الإيجار وأهم مزايا وعيوب كل معيار. ولقد تم التوصل إلى أن الإجارة المنتهية بالتمليك تتمتع بدرجة من المرونة تكمن في اختيار الأصل الذي يريده المستأجر ويعني ذلك أن ملكية الأصل المؤجر تبقى باسم البنك في التمويل الإسلامي، بحيث تقع الخسائر ومصاريف التأمين على البنك، بينما تنتقل ملكية الأصل المؤجر في التمويل التقليدي لصالح المستأجر وهذا يعني أن المستأجر هو من يتحمل الخسائر ونفقات التأمين، مما أدى إلى إقبال كبير المستثمرين على التمويل بالصيغ الإسلامية وبالمقابل تراجع في الطلب على التمويل التقليدي. Abstract: This study aims to compare the lease contract according to IFRS16 and the Ijarah Muntahia Bittamleek standard issued by AAOIFI, so that the financing tool with the lease contract and the most important advantages and disadvantages of each standard are identified. It has been found that the expired lease enjoys a degree of flexibility in choosing the asset that the lessee wants. Meaning that ownership of the leased asset remains in the bank's name in Islamic finance, so that losses and insurance expenses fall on the bank, while ownership of the leased asset in traditional financing moves in favour of the lessee. Which means that the bears the losses and insurance expenses, and this has led to a great demand by investors for financing in islamic forms, and in return, a contrast in the demand for traditional financing.
