الغرامة التهديدية كوسيلة ضغط على الإدارة- دراسة مقارنة-.

Résumé: لقد حظي موضوع الغرامة التهديدية في الجزائر باهتمام فقهي كبير، و ذلك راجع لتضمن قانون الإجراءات المدنية السابق أحكاما تنظم الغرامة التهديدية، إلا أن تطبيق هذه الأحكام على المنازعات التي تكون الإدارة طرفا فيها كان مرفوضا آنذاك من طرف القضاء الإداري الجزائري كقاعدة عامة تم الخروج عنها في حالات استثنائية. و قد كان هذا الرفض محل انتقاد واسع من طرف أغلبية الكتاب و المختصين في القانون الإداري بالجزائر، إلى أن وضع المشرع الجزائري حدا لهذا الخلاف بموجب قانون الإجراءات المدنية و الإدارية سنة 2008، حيث نص صراحة على سلطة القضاء الإداري في الأمر بالغرامة التهديدية ضد الإدارة لإجبارها على تنفيذ الأوامر الصادرة في مواجهتها، فهي تشكل وسيلة ضغط على الإدارة. The subject of the threatening fine in Algeria has received significant legal attention, as the previous Civil Procedure Act contained provisions regulating the threatening fine. However, the application of these provisions to disputes in which the administration was a party was rejected by the Algerian administrative judiciary as a general rule, except in exceptional cases. This rejection was widely criticized by the majority of writers and experts in Algerian administrative law, until the Algerian legislator put an end to this dispute by enacting the Civil and Administrative Procedure Act in 2008, which explicitly granted the administrative judiciary the authority to order a threatening fine against the administration to compel it to execute its orders. Therefore, it represents a means of pressure on the administration
