تأثير حدود استقلالية مجلس المنافسة على ممارسة دوره الضبطي

Résumé: استحدث القانون مجلس المنافسة لضبط المنافسة في السوق، ولأجل ممارسة دوره الضبطي خوله صلاحيات واسعة لقمع الممارسات المقيدة للمنافسة والتي تندرج ضمن اختصاصه للبث فيها حيث يتدخل عند اللزوم لوضع حد لها، متمتعا بالاستقلالية والتي تعني سلطة اتخاذ القرارات وتوقيع الجزاءات دون الخضوع للتبعية لأية جهة كانت مع الخضوع للرقابة القضائية، تأتي هاته الورقة البحثية لتسليط الضوء على حدود استقلالية مجلس المنافسة وتأثير ذلك على فعالية دوره الضبطي في السوق. Abstract: The law created the Competition Board to regulate competition in the market, and in order to exercise its regulating role, gave it broad powers to suppress practices that restrict competition and which fall within its competence to broadcast them, enjoying independence, which means the power to make decisions and impose the penalty without subordination to any party, but subject to judicial oversight. This research paper comes to shed light on the limits of the independence of the Competition Board and the effect of that on the effectiveness of its regulating role in the market.
