حل تنازع الاختصاص و مسائل الارتباط و التسوية القضائية وفقا للقانون الجديد22 /13

Résumé: ملخص بالرغم من أن المشرع الجزائري قد أحاط الهيئات القضائية الإدارية بمجموعة من النصوص لتوزيع الاختصاص في ما بينهم ، إلا انه لم يقض تماما على التنازع بين هذه الهيئات ، خاصة بعد تنصيب المحكمة الإدارية للاستئناف كهيئة قضائية جديدة في القضاء الإداري ،فكان من الضروري على المشرع الجزائري إعادة توزيع الاختصاصات بين هذه الهيئات . في هذه الورقة البحثية أردنا أن نسلط الضوء على ما جاء به القانون 22/13 المعدل و المتمم للقانون 08/ 09المتعلق بقانون الإجراءات المدنية و الإدارية من حلول في مجال تنازع الاختصاص بين الجهات القضائية الإدارية و النظام الجديد الذي يعالج مسائل الارتباط و التسوية القضائية . abstract Although the Algerian legislator surrounded the administrative judicial bodies with a set of texts to distribute jurisdiction among them, it did not completelye liminate the conflict between these bodies, especially after the installation of the Administrative Court of Appeal as a new judicial body in the administrative .judiciary, soit was necessary for the Algerian legislator to redistribute terms of reference between these bodies. In this research paper, we wanted to shed light on the solutions provided by Law 13/22, amending and supplementing Law 08/09 related to the Civil and Administrative Procedures Law, in the field of conflict of jurisdiction between the administrative judicial authorities and the new system that deals with issues of engagement and judicial settlement. .Keywords: conflict of jurisdiction - association - settlement - Administrative Court of Appeal
