تطور الضمانات القانونية الدولية لحماية حقوق الطفل والمرأة

Résumé: اكتسب مفهوم حقوق الإنسان قبولاً على المستوى الدولي ، فقد حاولت العديد من الدول العربية إضفاء الصبغة الإسلامية على المفهوم، فبرزت كتابات تتحدث عن "حقوق الإنسان في الإسلام"،ومن ابرز الحقوق التي كفلها الاسلام ومختلف المواثيق الدولية هي حماية حقوق المرأة والطفل. فلا بد لنا قبل أن الحديث عن حقوق المرأة والطفل يجب اولا استعراض أوضاع المرأة والطفل الاجتماعية والقانونية في المجتمعات القديمة حتى ظهور الاسلام ثم فيما بعد ذلك في أوروبا في القرون الوسطى والعصور الحديثة. فما هي اهم الضمانات القانونية التي كفلتها مختلف الاتفاقيات الدولية في حماية حقوق الطفل والمرأة أثناء السلم والحرب؟ وما هي أهم الآليات للحد من الانتهاكات الجسيمة ضدهم؟ كفل القانون الدولية حقوق كلا من الطفل والمرأة في مختلف الاتفاقيات والإعلانات الدولية أبرزها:الاعلان العالمي لحقوق الإنسان"حق المرأة والطفل"، اتفاقية حقوق الطفل، اتفاقية القضاء على جميع أشكال التمييز ضد المرأة وكذلك ابراز دور القضاء الوطني والدولي في حماية حقوقهم.
