اختياراتُ يَحيَى بنُ سَلام الفِقهيَّة في التَّفسير – مَسائِل الحُدود انموذجا –

Résumé: يُحظَى تفسير يحيى بن سلام البصري بقيمة علميةٍ كبيرةٍ، إذ يعدُّ أقدمُ تفسيرٍ شاملٍ بين أيدينا، كما يُعدُّ حلقة ربط في تطوّر علم التفسير بين القرن الأوَّل الهجري والثَّاني الهجري، وقد سلك فيه مؤلّفُه منهج التفسير النّظري، واعتَنى كثيراً بالجانب الفقهي عند تفسيره لآيات الأحكام. - وقد كانت له اختيارات فقهيّة عند تفسيره لآيات الحدود في سورة النُّور، فاختار في حدّ الزنى، عدم جمع الجَلْد مع الرَّجم للزَّاني المحصَن، واختار أن لا تُقبل شهادة شهود الزِّنى حتى يأتوا مجتمعين، وأن من شروط الإحصان الإسلام، وفي القذف اختار نصف الحدّ على العبد إن قَذَفَ غيره بالزنى، وأنّ القاذف لا تقبل شهادته أبدا وإن تاب. The interpretation of Yahya bin Salam Al-Basri has great scientific value, as it is the oldest comprehensive interpretation in our hands. It is considered as a link in the development of the science of interpretation between the first century AH and the second AH. Its author conducted the approach of theoretical interpretation, and took a great care of the jurisprudential aspect when interpreting Ayat Al-Ahkam. He had jurisprudential choices when interpreting the verses of the prescribed punishment in Surat Al-Nor. He chose in the prescribed punishment for fornication not to combine lashing with stoning for the married adulterer. In addition, he chose not to accept the testimony of the witnesses for adultery until they come together, and that one of the conditions of marriage is Islam. In slandering, he chose half of the punishment on the person if he slanders another person for fornication, and that to reject his testimony even if he repents.
