الاختيارات الفقهية للإمام المازري في باب المعاملات من خلال كتابه شرح التلقين

Résumé: "ملخص البحث تناولنا في بحثنا هذا، الاختيارات الفقهية للإمام المازري من خلال كتابه شرح التلقين، باب المعاملة، فدرسنا عن الإمام، وعن حياته، وبما تميز كتابه شرح التلقين الذي اشتهر به؟ اخترنا أهم مسائل المعاملات، وخصصنا عقود المعاوضات منها بالجمع والدراسة، حيث تضمن بحثنا ثلاثة مباحث، الأول عن الإمام وحياته،وكتابه، والثاني عن تعريف مصطلحات البحث وبعض مميزاتها، مسائل واختيارات الإمام فيها ودراستها، وما تصلنا إليه، أن الإمام برغم من انتسابه للمذهب المالكي، إلا أنه لا يعترف بالري إلا بعد النظر في دليله، وثبوت صحته، وهذا دليل على اجتهاده. ""Abstract In our research, we dealt with the jurisprudential choices of Imam Al-Mazri through his book Sharh Al-Talqin, the chapter about treatment, so we studied about the imam, his life, and what distinguished his book that made him famous. We chose the most important transaction issues, and we allocated the contracts of compensation by collection and study, where our research included three sections, the first was devoted to the Imam, his life, and his book, and the second was about the definition of research terms and some of their features, issues and choices of the Imam and their study. We concluded that the Imam despite his affiliation with the Maliki school However, he does not recognize opinion until after looking into its evidence and establishing its validity, and this is the evidence of his ijtihad."
