القرار الإداري محل الخصومة الإدارية كشرط لقبول دعوى الإلغاء

Résumé: إذا كان الطعن بالإلغاء رخصة بوسع من مسّ القرار مصالحه وذلك لاستعمالها لمواجهة آثار القرار الضارة، إلا أن الحق شأنه كشأن كل حق، له شروط لابد من توافرها حتى تكون هذه الدعوى مقبولة، فإذا رأى القاضي الإداري أثناء النظر في مشروعية القرارات الإدارية توافر أيا من أسباب الإلغاء يوجب عليه إلغاؤه شريطة أن يتم استيفاء شروط إقامة دعوى الإلغاء، لأن الأسباب أو ما يطلق عليها بصور عدم المشروعية والشروط الواجب توافرها في القرار كل لا يتجزأ بالنسبة لدعوى الإلغاء. الكلمات المفتاحية: القرار، الإدارة، الشروط، دعوى، الخصومة، الإجراءات، الإلغاء. Abstract: If the appeal against the revocation of a license enables the decision to affect its interests in order to use it to deal with the harmful effects of the decision, the right, like any other right, has conditions that must be met in order for this case to be admissible. If the administrative judge considers the legality of the administrative decisions, Cancellation must be canceled provided that the conditions of the cancellation proceedings are met, because the reasons or so-called illegitimate terms and conditions to be met in the decision are indivisible in relation to the claim of cancellation.
