عقد الشراكة الفلاحية كآلية محفزة لتطوير الاستثمار الفلاحي بالجزائر

Résumé: كانت ولازالت الأراضي الفلاحية التابعة للأملاك الخاصة للدولة تشكل أحد المحاور الاستراتيجية الكبرى التي تساهم بفعالية في تسريع وتيرة التنمية ودعم الاقتصاد الوطني، فمنذ الاستقلال كرست الجزائر عدة أنماط من التسيير سعت من خلالها إلى تنظيم وحسن استغلال هذا النوع من الثروة العقارية، من بينها عقد الامتياز المنظم بمقتضى القانون رقم 10-03، هذا الأخير الذي استحدث عقد الشراكة الفلاحية كتجربة جديدة بموجبها يمكن لأعضاء المستثمرات الفلاحية إبرام اتفاقات شراكة مع أشخاص لهم مؤهلات مالية وتقنية عالية من شأنها أن تعطي دفعا قويا للإنتاج المحلي، ما يمكن من استقطاب رؤوس الأموال وتحرير القطاع الفلاحي من البدائية والمضي به قدما نحو الأمام. بما أن نمط التعاقد بالشراكة أصبح اليوم من أهم عوامل إنجاح السياسة الفلاحية بالجزائر، فإن هدف البحث هو دفع المشرع إلى وضع إطار قانوني منظم ومتكامل يحدد فيه بدقة العناصر التي أغفلها لعقد الشراكة الفلاحية، حيث أنه كان قد خصص لها مادة وحيدة فقط بمقتضى القانون رقم 10-03 الذي يحدد شروط وكيفيات استغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة Abstract: The agricultural lands belong to the state’s private properties were and still constitute one of the major strategic axes, that contribute effectively to accelerating the pace of development and supporting the national economy, Since independence, Algeria has devoted several modes of management through which it has sought to organize and properly exploit this type of real estate wealth, including the concession contract organized according to law N°10¬¬-03, this latter which created the agricultural partnership contract as a new experience under which members of agricultural investors can conclude partnership agreements with persons they have high financial and logistical qualifications that would give a strong impetus to local production, which would enable attracting capital and liberating the agricultural sector from the beginning and moving it forward. Since the model of the partnership contract has become today one of the most important factors for the success of agricultural policy in Algeria, the aim of this research is to push the legislator to establish an organized and integrated legal framework, that determines exactly the elements that he has neglected. Whereas, he was assigned only a single article in accordance with law 10-03 which specifies the conditions and modalities for the exploitation of agricultural lands belonging to the private property of the state.
