العلاقة بين السلطات في التعديل الدستوري لسنة 2020

Résumé: تخلف العلاقة بين السلطات (التشريعية، التنفيذية، القضائية) من نظام إلى آخر، خاصة العلاقة بين السلطتين التنفيذية والتشريعية، التي تتراوح بين التعاون والتوازن وحتى الاستقلال شبه المطلق، لكن في كل الحالات تسعى جميعها لتحقيق الهدف المشترك والمصلحة العامة. فباختلاف الأنظمة تمنح للسلطة التنفيذية وسائل لمراقبة السلطة التشريعية والعكس صحيح، لأنه لا يحد من السلطة إلا سلطة مثلها. يهدف هذا البحث للوقوف على العلاقة بين السلطات في التعديل الدستوري الجزائري لسنة 2020، ومعرفة الممنوحة لكل سلطة لمراقبة السلطة الأخرى، ومدى فعالية هذه الوسائل من الناحية التطبيقية. وبعد البحث والدراسة خلصنا إلى أن السلطة التنفيذية تملك من وسائل المراقبة ما يجعل السلطة التشريعية كتابع لها وتحت السيطرة، وما منح للسلطة التشريعية من وسائل عبارة عن نصوص قانونية وفي بعض المرات يصعب تطبيقها أو وجود فراغات قانونية تمنح الحكومة التهرب من المراقبة. Abstract: The relationship between the authorities (legislative, executive, judicial) lags from one system to another, particularly the relationship between the executive and legislative branches, ranging from cooperation and balance to almost absolute independence, but in all cases they all seek to achieve the common goal and the public interest. Different regulations give the executive branch means to control the legislature and vice versa, because it limits power only to one like it. This research aims to determine the relationship between the authorities in Algeria's 2020 constitutional amendment, the knowledge given to each authority to monitor the other authority, and the practical effectiveness of these means. After research and study, we concluded that the executive had the means of control that placed the executive branch under control, and that the means given to the legislature were legal provisions and, at times, difficult to apply or legal vacuums that gave the Government evasion of surveillance.
