دعوى وقف تنفيذ القرارات الإدارية

Résumé: قمنا بدراسة نظام وقف تنفيذ القرارات الإدارية وفقا لقانون الإجراءات المدنية والإدارية وفقا لقانون الإجراءات المدنية و الإدارية، بإعتباره كإجراء إستثنائي عن مبدأ الأثر غير الموقف للطعن بالإلغاء، وذللك من أجل سد العيوب المترتبة عن هذا المبدأ و المتمثلة في طول إجراءات التقاضي والتي تستغرق وقتا طويلا بين مرحلة صدور القرار و الحكم في دعوى إلغاء القرار الإداري. كما تضمنت الدراسة الشروط الشكلية والموضوعية لوقف تنفيذ القرار الإداري سواء أمام قاضي الموضوع أو أمام قاضي الإستعجال.حيث تصدر أوامر وقتية من القاضي المختص وقطعية فيما فصل فيه سواء بالرفض أو القبول، ويمكن الطعن فيها بالإستئناف في حالة الأوامر الصادرة عن قاضي الموضوع دون إمكانية إستئنافها أمام قاضي الإستعجال. الكلمات المفتاحية:القرارات، الإدارية، وقف، التنفيذ، إستعجالية،الطعن، دعوى Abstract We examined the system of suspension of administrative decisions in accordance with the Civil Administrative Procedures Law as an exceptional measure of the principle. The non –effect of the appeal against cancellation. This study included the formal and obgective conditions for stopping the execution of the administrative decisions either befor the trial judge or befor the emergency judge. So thattempraryordres are issued by appealed against in the case of orders issued by the trial judge without the possibility of doing so befor the emergency judge.
