مواجهة خطاب الكراهية على مواقع التواصل الاجتماعي في التشريعات العربية: الجزائر نموذجا

Résumé: أدت الزيادة المطردة في استخدام مواقع التواصل الاجتماعي إلى تفشي خطابات الكراهية عبر هذه التقنيات بشكل سريع ومخيف، الأمر الذي استدعى معه ضرورة ملحة لمواجهة هذا الإجرام الذي يقلق مختلف الدول بما فيها العربية ويهددها في استقرار أمنها وسلمها. تعد الجزائر من بين الدول العربية التي سعت لمكافحة خطاب الكراهية، وأدركت أن الترسانة القانونية الموجودة غير كافية لمواجهة التصاعد الخطير لهذه الجريمة، ما دفع بالمشرع إلى اعتماد القانون رقم 20-05، المؤرخ في 28 أفريل 2020 المتعلق بالوقاية من التمييز وخطاب الكراهية ومكافحتهما؛ من هنا تسعى هذه الدراسة إلى الإجابة على إشكالية هامة تكمن في ماهية الإستراتيجية القانونية المكرسة في القانون الجزائري لمواجهة خطاب الكراهية عبر مواقع التواصل الاجتماعي بوصفه نموذجا خطيرا للإجرام الالكتروني؟ The constant increase in the use of social networking sites has led to the spread of hate speech through these technologies in a rapid and chilling manner, which has necessitated an urgent need to deal with this crime which worries various countries, including Arab countries, and threatens their stability security and peace. Algeria is one of the Arab countries which have sought to combat hate speech, and have realized that the existing legal arsenal is insufficient to deal with the dangerous escalation of this crime, which has prompted the legislator to adopt the Law No. 05-20 of April 28, 2020 on preventing and combating discrimination and hate speech; From there, this study seeks to answer an important problem which lies in what is the legal strategy enshrined in Algerian law to confront hate speech through social networking sites as a dangerous model of cybercrime?
