جبر ضرر ضحايا الجرائم الدولية أمام المحكمة الجنائية الدولية

Résumé: تهدف هذه الدراسة إلى تسليط الضوء على دور المحكمة الجنائية الدولية في حماية حقوق الضحايا بما تملكه من سلطات، نتيجة لتزايد عدد ضحايا الجرائم الدولية، وذلك من خلال ما يتضمنه النظام الأساسي للمحكمة من أحكام تتعلق بحقوق هذه الفئة الضعيفة من الضحايا، وإدراكا من المحكمة بأن إنفاذ العدالة الجنائية لا يتحقق فقط بالردع و توقيع العقاب الجزائي على الجاني، بل الأهم من ذلك أن تتحقق العدالة بموجب تدابير إنصاف الضحايا من خلال اعتماد منظومة لجبر الضرر، وتشكل هذه المنظومة إحدى أهم مميزات نظام روما وخطوة غير مسبوقة في تاريخ القضاء الجنائي الدولي، غير أن هذه الحقوق قد تصطدم ببعض العوائق التي تشكل عقبة دون الوصول لتحقيقها خاصة إذا تجاهلنا دور الجهاز الجديد المحدث في إطار جبر الضرر المعروف بــــ' الصندوق الإستئماني'، و الذي يعتبر إحدى الخصائص المميزة التي تنفرد بها المحكمة الجنائية الدولية على غرار باقي المحاكم في ميدان تعويض الضحايا. Abstract: This study aims to highlight the role of the International Criminal Court in protecting the rights of victims with the powers it possesses, as a result of the increasing number of victims of international crimes, through the provisions in the statute of the court regarding the rights of this vulnerable group of victims, and the awareness of the court that enforcement Criminal justice is not only achieved by deterrence and the imposition of criminal punishment on the perpetrator, but more importantly, justice is achieved in accordance with measures to redress the victims through the adoption of a system of reparation, and this system constitutes one of the most important features of the Rome system and an unprecedented step in the history of international criminal justice, but that This right And it may collide with some obstacles that constitute an obstacle without reaching its fulfillment, especially if we ignore the role of the new updated body in the context of reparation known as the 'Trust Fund', which is one of the distinctive characteristics of the International Criminal Court, like other courts in the field of compensation to victims.
