اثبات النسب بالطرق العلمية الحديثة في التشريع الجزائري
Résumé: ملخص باللغة العربية تعد إشكالية إثبات النسب بالطرق الحديثة، من المسائل العويصة التي تطرح على القضاء، حيث يتم تسليط الضوء فيها على ما جاءت به أحكام المادة 40/2 من قانون الأسرة الجزائري. أين تم فيها تجاوز الإثبات التقليدي للإثبات بطرق تتماشى مع التطورات العلمية الحديثة. وأهم هذه الطرق البصمة الوراثية أو تحليل الحمض النووي، وتحليل فصائل الدم. ويجدر بنا البحث للإجابة عن هذه الإشكالية في مدى كفاية هذه الطرق لإثبات النسب، ومدى نجاعتها الفعلية في إثبات النسب، وبيان حجيتها، وهذا حفاظا على تحديد هوية الأطفال من الضياع، في ظل أحكام القانون. ملخص باللغة الإنجليزية The problem of proving parentage by modern methods is one of the difficult issues that are raised on the judiciary, where the light is highlighted on the provisions of Article 40/2 of the Law the Algerian family. Where has the traditional proof of proof been bypassed in ways that are consistent with Recent scientific developments. The most important of these methods is genetic fingerprinting or acid analysis nuclear, and blood group analysis. It is worth looking for an answer to this problem in a range the adequacy of these methods to prove parentage, and the extent of their actual effectiveness in proving parentage, and a statement Authenticity, and this is to preserve the identification of children from loss, under the provisions of the law.
