جريمة الرشوة بين الشريعة الإسلامية والقانون الجزائري - دراسة مقارنة -
Résumé: هدفت الدراسة إلى معرفة آثار جريمة الرشوة بين الفقه الاسلامي والقانون الجنائي الجزائري في تحديد مفهوم جريمة الرشوة شرعا وقانونا، وتمييزها عن ما يشابهها وبيان أركانها. وكذا التحسيس بخطورة الرشوة وبيان آليات وتدابير الوقاية منها، بالإضافة إلى بيان العقوبات والجزاءات المترتبة على مرتكبي جريمة الرشوة في الفقه الاسلامي والقانون الجنائي الجزائري. ودراستنا لهذا الموضوع المتعلق بجريمة الرشوة، كدارسة مقارنة بين الشريعة الإسلامية والقانون الجزائري: ممثل في قانون العقوبات، والقانون 06-01، المتعلق بالوقاية من الفساد ومكافحته. وتتعلق هذه الدراسة بالآثار الخطيرة على الدولة، خاصة وأنها أخذت حيزا كبيرا في الانتشار في كافة المجالات، وباعتبار أن أثرها يمس المجتمع بأسره إضافة، إلى التأثير على ثقة الأفراد في الإدارات العمومية، مؤسسات الدولة، فإنها بذلك تهدد اقتصاد الدولة وكيانها، كما أن المجتمعات الدولية أصبحت تولي أهمية كبيرة للموضوعات المتعلقة بالفساد المالي، من أجل إيجاد حلول للقضاء على كل أشكاله. الكلمات المفتاحية: الرشوة، الفقه الإسلامي، القانون الجنائي الجزائري Abstract: The study aimed to know the effects of the crime of bribery between Islamic jurisprudence and the Algerian criminal law in defining the concept of the crime of bribery legally and legally, distinguishing it from similar ones and clarifying its pillars. As well as raising awareness of the danger of bribery and explaining the mechanisms and measures to prevent it, in addition to clarifying the penalties and penalties incurred by the perpetrators of the crime of bribery in Islamic jurisprudence and Algerian criminal law. And our study of this topic related to the crime of bribery, as a comparative study between Islamic law and Algerian law: represented in the Penal Code, and Law 06-01, related to the prevention and control of corruption. This study is related to the serious effects on the state, especially as it has taken a large spread in all fields, and considering that its impact affects the entire society in addition to affecting the confidence of individuals in public administrations, state institutions, thus threatening the state’s economy and entity, and international societies I have become attaching great importance to issues related to financial corruption, in order to find solutions to eliminate all its forms.
