مستقبل الرقابة على دستورية القوانين -المحكمة الدستورية الجزائرية نموذجا-

Résumé: ملخص: شهد موضوع الرقابة على دستورية القوانين اهتماما غير مسبوق بحيث اعتمدت دساتير معظم الدول هذا النظام بناء على دوره الفعال في إرساء مقومات دولة القانون، الذي يقتضي إخضاع سلطات الدولة ومؤسساتها لسلطان القانون، ليتم اعتماده بعد ذلك كمعيار لتصنيف النظام السياسي للدول ما إذا كان ديموقراطيا أو شموليا. والمؤسس الدستوري الجزائري بدوره ساير التطور الطارئ على أساليب الرقابة على دستورية القوانين بتبنيه نمطا جديدا من الرقابة على دستورية القوانين، بعد أن استحدث في التعديل الدستوري الأخير هيئة قضائية تختص بذلك وهي "المحكمة الدستورية"، هذا ما يدعو إلى التساؤل عن مكانة المحكمة الدستورية كهيئة مستحدثة في تعزيز مستقبل الرقابة عل دستورية القوانين في الجزائر؟ Abstract: the constitutions of most countries have adopted this system based on its effective role in establishing the foundations of the state of law, which requires subjecting the state’s authorities and institutions to the rule of law, to be adopted after that as a standard for classifying the political system of countries. Whether it is democratic or totalitarian . The Algerian constitutional founder, in turn, followed the evolution of the methods of monitoring the constitutionality of laws by adopting a new type of oversight over the constitutionality of laws, after the recent constitutional amendment created a judicial body that is competent to do so, which is the "Constitutional Court". This calls into question the status of the Constitutional Court as a body Created to strengthen the future of oversight over the constitutionality of laws in Algeria?
