النظام القانوني للمحاكمة الفورية في التشريع الجزائري

Résumé: تتمثل المحاكمة الفورية في إتباع إجراءات بسيطة وغير معقدة بداية من مجريات رفع الدعوى العمومية مرورا بجميع المراحل التي تمر بهم الدعوى العمومية وصولا إلى تنفيذ الحكم الجزائي في حالة الحكم بالإدانة. وقد تبنى المشرع الجزائري المحاكمة الفورية في الجرائم الواقعة في الجلسات في قانون الإجراءات الجزائية، ثم تبنى الأمر الجزائي في مجال المخالفات والتي يمكن تطبيق عليها غرامات الصلح، وأخيرا تم استحداث صور جديدة للمحاكمة الفورية والمتمثلة في إجراء المثول الفوري في جرائم التلبس، وهذا ما سوف نسلط عليه الضوء في دراستنا. The immediate trial consists in following simple and uncomplicated procedures, starting from the proceedings of filing the public lawsuit, passing through all the stages that the public lawsuit goes through, all the way to the implementation of the criminal judgment in the case of a conviction. The Algerian legislator has adopted the immediate trial in the crimes occurring in the sessions in the Code of Criminal Procedure, then adopted the penal order in the field of violations to which conciliation fines can be applied, and finally new forms of the immediate trial have been developed, represented in the immediate appearance procedure in flagrante delicto crimes, and this is what we will highlight highlighted in our study.
