الحق في التظاهر السلمي بين حرية الممارسة وقيود النظام العام

Résumé: يعتبر حق التظاهر السلمي من أبرز الحقوق التي كرستها الإتفاقيات والمواثيق الدولية المتعلقة بحقوق الإنسان، كما كفل المؤسس الدستوري الجزائري هذا الحق في مختلف دساتير الدولة. وفي إطار المحافظة على النظام العام للدولة لاسيما في شقيه الأمني والصحي وضع المشرع الجزائري قيودا على حرية ممارسة هذا الحق، تختلف بإختلاف الأوضاع السائدة في البلاد، بحيث يكون التقييد في الأوضاع العادية يتسم ببعض المرونة على عكس التقييد الذي يصاحب الأوضاع الإستثنائية التي يمكن أن يصل فيها الأمر إلى المصادرة والحرمان الكلي لهذا الحق. The right to peaceful protest is regarded as one of the most prominent rights enshrined in international treaties and charters concerned with human rights, as the Algerian Constitutional Institution has guaranteed this right in the various State constitutions. In the context of retaining the State's public order, particularly its security and health aspects; the Algerian legislator has placed restrictions on the free exercise of this right, which vary according to the prevailing conditions in the country. In normal circumstances, the restriction is characterized by some flexibility, as opposed to the restriction that accompanies exceptional situations where confiscation and total deprivation of this right may occur.
