دور الجمارك الجزائرية في حماية المنتوج الوطني بين حتمية التسهيلات الجمركية وضرورة الرقابة

Résumé: فرض اقتصاد السوق على إدارة الجمارك ضرورة تقديم عدة تسهيلات جمركية من أجل تسهيل وتبسيط وتسريع عمليات التجارة الخارجية وترقية المبادلات التجارية الدولية، ولكن الدخول من باب اقتصاد السوق لا يعني بالضرورة الخروج من باب حماية الاقتصاد الوطني، فإدارة الجمارك ملزمة بالقيام بمهامها الرقابية على المنتوجات المستوردة حتى لا يتم إغراق السوق الجزائرية بمنتوجات مشبوهة تهدد الإنتاج الوطني وتشكل خطرا على صحة المستهلك، وأمام ضرورة التسهيلات وحتمية الرقابة تجد إدارة الجمارك نفسها أمام دور صعب يتجسد في التوفيق بين هاتين العمليتين، لذا قامت بتبني الرقابة اللاحقة كأسلوب لتحقيق هذه الموازنة، نظرا لدورها في إضعاف محاولات الغش الجمركي وضمان حقوق الخزينة العمومية والمنافسة الشريفة والعادلة. Abstract: The market economy imposed on the customs administration the necessity of providing several customs facilities in order to facilitate, simplify and speed up the operations of foreign trade and promote international trade exchanges, but entry from the market economy does not necessarily mean leaving the door to protect the national economy, since the customs administration is obligated to carry out its control tasks on imported products To protect the Algerian market from being flooded with suspicious products that threaten national production and threaten consumer health, Between the necessity of facilitation and the imperative of supervision, the Customs Administration finds itself in front of a difficult role that is embodied in the reconciliation of these two processes, and it has adopted the following control as a method to achieve this budget in view of its role in weakening customs fraud efforts, ensuring public treasury rights and ensuring fair competition.
