حقوق الانسان و الأمن القومي

Résumé: الملخص: جدلية العلاقة بين الأمن و حقوق الإنسان مسألة غاية في الأهمية، باعتبارها جدلية أزلية تسعى للموازنة بين حماية الأمن القومي للدولة من جهة و احترام حقوق الإنسان من جهة أخرى ضمن ثنائية متناغمة، بمعنى أن محافظة الدولة على أمنها القومي لا يمكن بأي حال من الأحوال أن يكون ذريعة لخرق حقوق الإنسان و حياته الأساسية، لذلك لابد أن تكون الإجراءات التي تتخذها الدولة لمواجهة كل ما من شأنه تهديد أمنها القومي، محسوبة و مقيدة بقيود القانون و بالمبادئ الوطنية و الدولية لحقوق الإنسان، لذا بات من الضروري إيجاد نوع من التوازن بين متطلبات حماية الدولة لأمنها القومي، و وجوب احترامها لحقوق الإنسان حتى في ظل الظروف الاستثنائية التي قد تواجهها. Abstract: The dialectical relationship between national security and human rights is very important, as an eternal dialectic, it seeks to balance the protection of national security on one hand and human rights on the other, within a harmonious duality. This means that a state’s preservation of its national security can never be a pretext for violating human rights and fundamental freedoms, therefore the measures taken by the state to counter any threats to its national security must be carefully considered and effective, while remaining bound by the rule of law and the national and internal principles of human rights. Hence, it has become essential to establish a balance between the state’s need to protect its national security and its obligation to respect human rights, even in exceptional circumstance.
