الحماية القانونية لحق الانسان في بيئة سليمة في ظل الظروف الراهنة

Résumé: ملخص: يحظى الحق في بيئة سليمة بأعلى درجات الاهتمام والرعاية من طرف المجتمع الدولي، هذا ماجعل القانون الدولي يحتضنه تحت كنفه، ويمنحه الحماية القانونية المرجوة، سواء في النصوص القانونية المتعلقة بحقوق الانسان، أو تلك المتعلقة بالبيئة، غير أن عدم إلزامية معظم قواعده القانونية جعلته يفشل في فرض حماية قانونية فعّالة له، لتلجأ عديد الدول بعدها إلى إدارجه ضمن تشريعاتها الداخلية، من أجل ضمان الحماية الكافية لحق الانسان في بيئة سليمة وتوفير الغطاء الحامي والواقي له من كافة الانتهاكات والمؤثرات الخارجية. لذلك سيتم من خلال هذه الدراسة البحث في مضمون كل حماية على حده، وذلك عند الاجابة على الاشكالية التالية: ماهي الحماية القانونية المقررة لحق الانسان في بيئة سليمة على المستويين الدولي والداخلي؟. Abstract: The right to a healthy environment receives the highest levels of attention and care from the international community, and this is why international law puts it under its auspices and gives it the desired legal protection, whether in human rights or environmental law. However, the non-application of most of its legal rules has prevented it from imposing effective protection on it. Accordingly, many countries have resorted to including it in their internal legislations, in order to ensure adequate protection of the human right to a healthy environment and to provide it with a protective cover from all external violations and influences. Therefore, through this study, the content of each protection will be examined separately, in order to answer the following question: What is the established legal protection for the human right to a healthy environment at the international and national levels?
