ضوابط زراعة الأعضاء البشرية بين الفقه الإسلامي و القانون الوضعي

Résumé: تعد عمليات نقل وزراعة الأعضاء البشرية من أىم العمليات الطبية الحديثة التي توصلت إليها الابتكارات العلمية. إلا أن ىذه العمليات من الناحية البشرية والقانونية غير مطلقة ذلك أن الخروج عن الضوابط الدقررة لذا يجعلها لزرمة من الناحية الشرعية ولررمة من الناحية القانونية وخاصة إذا تعلق الأمر بالاتجار بالأعضاء البشرية غير أن تحقيقا للغاية العلاجية من عمليات نقل وزرع الأعضاء البشرية تم إقرار إباحتها في بعض الدواطن بشروط متعلقة أغلبها برضي الدتبرع والقائم بالعملية وأن يكون عن غرض علاجي بالدرجة الأوى. وفي الأخير فإن السياسة الجنائية التي يتبعها الدشرع الجزائري يسعي من خلالذا إى مواكبة التطورات في كافة المجالات ، وخاصة المجال الطبي لدا يحقق الصالح العام ويحافظ على حرمة وكرامة الإنسان.It considers transplantation of human from the most modern operations reached by the medical innovation and scientific operations.
