دور المحكمة الرياضية الدولية في التصدي للمنازعات الرياضية

Résumé: تهدف هذه الدراسة إلى تسليط الضوء على دور المحكمة الرياضية الدولية في التصدي للمنازعات الرياضية عبر آلية الوساطة. و لقد اتبعنا في هذا البحث المنهج الوصفي والتحليلي بغرض وصف وتحليل مختلف النصوص القانونية المتعلقة بالوساطة الرياضية والصادرة في اطار اختصاصات المحكمة الرياضية، مما سمح لنا بالتوصل الى نتائج أهمها : أن الرياضة لا تخلوا من المنازعات، وبالتالي وجب توفر الجهات المختصة بالفصل في أي نوع من المنازعات الرياضية، أين تعتبر المحكمة الرياضية الدولية من أهم هذه الجهات كما وتعتبر آلية الوساطة أداة ودية هامة تساهم في حل المنازعات الرياضية. Abstract: This study aims to shed light on the role of the International Sports Court in addressing sports disputes through the mediation mechanism. In this research, we have followed the descriptive and analytical approach in order to describe and analyze the various legal texts related to sports mediation issued within the jurisdiction of the Sports Court, which allowed us to reach results, the most important of which are: that sports are not devoid of disputes, and therefore the competent authorities must be available to adjudicate in any type of Sports disputes, where the International Sports Court is one of the most important of these bodies, and the mediation mechanism is an important friendly tool that contributes to resolving sports disputes.
