ضمان حق التعليم للأطفال ذوي الاعاقة في القانون الجزائري

Résumé: ملخص: إن حق الطفل ذوي الاعاقة في التعليم من الحقوق الأساسية، لتأثيره في إعمال حقوقه الأخرى ولأهمية النتائج المترتبة عنه في تطوره ونمائه الاقتصادي والاجتماعي، مما يقتضي الحرص على ضمان تمتع الأطفال المعوّقين بصورة كاملة بحقوق الإنسان والحريات الأساسية ومشاركتهم الكاملة، على نحو يُفضي إلى زيادة الشعور بالانتماء وتحقيق تقدم كبير في التنمية البشرية والاجتماعية والاقتصادية للمجتمع. ولتمكين الأطفال المعوّقين من الحصول على التعليم المجاني الابتدائي والثانوي، الجيد والجامع، على قدم المساواة مع الآخرين في المجتمع، فإن القانون يضمن لهذه الفئة حق التعليم كسائر الأطفال، ولتحقيق هذا المسعى فقد وضع بعض الآليات تماشيا مع وضعية الطفل المعوّق كوضع ترتيبات قانونية وفنية ملائمة للتمدرس، وتأطير هيكلي خاص لضمان حق التعليم للأطفال المعوّقين. Ensure the right to education for the children with disabilities in Algerian Law Abstract The right to education of the child with disabilities is the basic. because of its importance and impact on the social and economic growth and development. The promotion of the full enjoyment by persons with disabilities of their human rights, fundamental freedom and the full participation, will build a sense of belonging and advances in the human, social and economic development of society. The child with disabilities can access an inclusive, quality and free primary education and secondary education on an equal basis with others in the community. The legislation ensures for children with disabilities the right to education. In order to ensure the realization of this right, some legal mechanisms have been developed, including the establishment of appropriate techniques and rules, and structural frameworks to ensure the right of education for children with disabilities.
