برامج المطابقة لقواعد المنافسة ومتطلبات تنفيذها

Résumé: منح المشرع لمجلس المنافسة صلاحيات عديدة، منها اتخاذ القرار في كل عمل أو تدبير من شأنه ضمان السير الحسن للمنافسة في السوق؛ وبموجب هذه الصلاحية فإن مجلس المنافسة اقترح وشجّع المؤسّسات على اعتماد برامج لمطابقة نشاطاتها لقواعد المنافسة في السوق، وقد وضع مجلس المنافسة في متناول المؤسسات إطارا عام لهذه البرامج تحت مسمى "المستند الإطار"، لكن الغموض الذي يكتسي إعداد وتنفيذ هذه البرامج جعل استجابة المؤسسات لاعتمادها قليلة جدا، وعليه كان الهدف هذه الدراسة هو التعريف ببرنامج المطابقة وما يجب أن يتضمنه وكذا كيفية تنفيذه، وفوائده. وتوصلنا في الدراسة الى عدة نتائج من شأنها أن تساهم في تبني المؤسسات الإقتصادية لبرامج مطابقة لقواعد المنافسة وبالتالي ترقية المنافسة الحرة والنزيهة بين الاعوان الاقتصاديين بما يعود بالفائدة على الاقتصاد الوطني والمستهلكين. The legislature has granted the Competition Board many powers, including the decision-making of any act or measure that would ensure good competition in the market; Under this authority, the Competition Board has proposed and encouraged enterprises to Adopt programs to match their activities with competition rules in the market, The Competition Board has made available to enterprises a general framework for such programs under the title "framework document", However, the ambiguity in the preparation and implementation of these programs has made the response of organizations to their adoption very low, and the objective of this study has been to define the program of conformity, what it should include, how it should be implemented, and its benefits. We have reached several conclusions that will contribute In adopting programs that match competition rules and thus promote economic institutions Free and fair competition among economic agents.
