القضاء في الجنوب الجزائري إبّان الاحتلال - الجنوب الغربي نموذجا-

Résumé: لجأت السلطة الاستعمارية وبهدف عزل سكان الجنوب وفصلهم عن المناطق الشمالية بشكل ممنهج ومقنّن، تمهيدا لفصل الصحراء عن الجزائر إلى تنظيم المنظومة القضائية تنظيما استثنائيا ومعقدا، بحيث تنّوعت اختصاصاتها وفق طبيعة الإدارة في الجنوب الجزائري التي جمعت بين السلطة العسكرية والوظائف القضائية، والصلاحيات الإدارية المحلية. ناهيك عن الصلاحيات الواسعة التي خوّلها القانون للقادة العسكريين في توقيع العقوبات. فقد خوّل لهم القضاء العسكري التدخل في سير الدعاوى والشكاوى، وغالبا ما كانوا يفصلون فيها غير مُكترثين بالعودة إلى القانون. ولم تختلف مهام المجالس القضائية في تنفيذ أحكامها عن مهام القادة العسكريين، إذ كثيرا ما كانت موّجهة لقمع الجزائريين في تلك الأقاليم. وغالبا ما كانت أحكامها تتميز بالتعسف والقسوة. The colonial authoritysought to isolate the southern population and to separate them from the northern regions in a systematic and formal manner in preparation for the separation of the desert from Algeria by organizing the judicial system in an exceptional and complex manner. The jurisdiction varied according to the nature of the administration in the south of Algeria, which combined military and judicial functions, without mentionning the extensive powers conferred by law to military commanders to impose sanctions. Military justice allowed them to intervene in proceedings and complaints. Often, cases were considered without return to law. The functions of the judicial councils in implementing their provisions were not different from those of military commanders, as they were often aimed at suppressing Algerians in these areas. His actions were often severe and harsh.
