دراسة تحليلية للمسؤولية المهنية للمرقي العقاري على ضوء المرسوم التنفيذي رقم 19-243

Résumé: الملخص: سعى المشرع الجزائري من خلال القانون رقم 11-04 المحدد للقواعد التي تنظم نشاط الترقية العقارية وكل نصوصه التنظيمية إلى ترقية مهنة المرقي العقاري، لكنه في المقابل أراد الموازنة بين مصالح المرقي العقاري من جهة وحماية المكتتبين من جهة أخرى، بالتشديد في إلتزاماته ومسؤولياته المهنية عن طريق إخضاعه لرقابة وجزاءات صارمة تصل إلى السحب النهائي للإعتماد. لكن تبقى الوسائل المتخذة في سبيل ذلك قاصرة عن تحقيق غايتها، لذا وجب تبني آليات ضبطية مستقلة لضبط مهنة المرقي العقاري، تحقق النجاعة والفعالية المرجوة منها في رقابة ومسائلة المرقي العقاري مسؤولية مهنية Abstract The Algerian legislator has sought, through Law N° 11-04 specifying the rules regulating the real estate promotion activity and all its regulatory texts, to upgrade the profession of real estate promoters, but in return he wanted to balance the interests of real estate promoters on the one hand and protecting subscribers on the other hand, by emphasizing his obligations and professional responsibilities by Subjecting him to strict control and penalties that reach the final withdrawal of approval. However, the means taken to achieve this remain limited to achieving its goal. Therefore, independent control mechanisms must be adopted to control the profession of real estate promoters, to achieve the desired efficacy and effectiveness in the supervision and accountability of real estate promoters.
