الالتزام بالإعلام قبل التعاقد كآلية قانونية لحماية المستهلك

Résumé: تهدف هذه الدراسة إلي توضيح الالتزام بالإعلام قبل التعاقد، وذالك لاعتباره أحد أهم الضمانات الأساسية والمهمة التي تكفل للمستهلك الحماية الكاملة في ظل انعدام التوازن المعرفي في العقد المراد إبرامه بينه وبين المهني (المتدخل)، وذلك لما يمتلكه هذا الأخير من قوة اقتصادية و ووسائل تساعده على الهيمنة على هذه العلاقة، مما ألزم على المشرع الجزائري إصدار قوانين ومراسيم تنظيمية تكفل إعادة التوازن من خلال فرض التزام على المهني(المتدخل) بإعلام المستهلك بكل صفات و خصائص المنتوج والمعلومات الأساسية المتعلقة بالخدمة محل التعاقد، وذلك ليصبح المستهلك مستنيرا قبل التعاقد مما يساعده على الإقبال على التعاقد أو الإحجام عنه وهو في دراية كاملة. This study aims to clarify the obligation of information before contracting, and you consider it one of the most important and essential guarantees that guarantee the consumer full protection under the lack of knowledge balance in the contract to be concluded between him and the professional (interviewer), This is because the latter possesses economic power and means that help him dominate this relationship, The Algerian legislature is obliged to issue laws and regulations that guarantee the restoration of balance by imposing an obligation on the employer to inform the consumer of all the characteristics and characteristics of the product and the basic information relating to the service in question, This is to make the consumer informed before contracting, which helps him to get involved or refrain from contracting and is fully aware.
